Special legislation and regulations apply to incidents that involve the Dutch or foreign armed forces.

The Dutch Safety Board may conduct investigations inside and outside the Kingdom on

  • occurrences that involve the Ministry of Defence ordealing with the consequences of occurrences in which the Ministry of Defence was involved

The Dutch Safety Board may investigate foreign armed forces that are involved in an occurrence in or above the Kingdom’s territory. The Dutch Safety Board is required to investigate aviation accidents involving aircraft being used by armed forces of two or more NATO member states.

The Dutch Safety Board is not mandated to conduct investigations in the following cases:

  • if the armed forces are deployed in a war situation or in an armed conflict,
  • if the armed forces are deployed to maintain or facilitate the international rule of law or
  • if the armed forces are deployed under the Police Act.
